Terms and Conditions

Acceptance

It is not necessary for the Client to have signed any document for these terms and conditions to apply. If the Client commissions artwork or shops from Created by Kenz Studio (aka Makenzie Wilson) then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.

Please read these terms and conditions carefully. Any commission or use of services implies that you have read, understood, and accepted these terms and conditions.

Description of Product (Original Work)

The painting will be produced on high quality stretched canvas, stretched linen, paper board, or watercolor paper (thickness and material specified and to be used according to medium chosen). The finished product will be protected from dirt, dust, and UV damage using a strong, high-quality varnish (if applicable based on medium used).

Description of Product (Prints)

Prints are made to order, professionally. Giclee prints are printed on 100% acid free textured paper (200 GSM). Each print is signed and numbered by the artist. All prints come unframed, unless professional

framing is ordered.

Description of Product (Commissioned Work)

The painting will be produced on high quality stretched canvas, stretched linen, paper board, or watercolor paper (thickness and material specified and to be used according to medium chosen). The finished product will be protected from dirt, dust, and UV damage using a strong, high quality varnish (if applicable based on medium used). The work will be based on either a photo to recreate (for example, your wedding photo), or a design based portrait painting that has been agreed upon by both parties. Design will be agreed upon prior to quote/invoice and payment. The artist reserves the right to turn down the commission if a good quality photo cannot be provided.

Photograph Rights

Reference photos that are not owned by the Client themselves must obtain permission from the owner of the photo. The same applies if the photograph was taken by a professional photographer: permission must be granted.

Payment

Prices are subject to change, however, once the 50% nonrefundable deposit has been paid the price is fixed. Payment may be made via website or payment link supplied. I require a 50% nonrefundable to secure your booking or reservation of original artwork. Once the artwork has been completed, the final payment of the remaining balance must be paid within 30 days before the artwork would be shipped or delivered/picked up. For original artwork, if the final payment is not received within the 30 days, the artwork will go back on the market and deposit will not be refunded. If the piece is a commissioned artwork and the Client is displeased with it’s outcome, and the displeasure cannot be resolved with minor alterations, then the final payment will not be charged. However, the Client will not receive the artwork. If the artwork is deemed acceptable for public sale, it will go on the market (This applies to commissions that do not include personal images).

Target Dates

Before the artwork is started, a target date for the completion of the art will be agreed. The Client will be notified once the product has been dispatched, or shipped, from which point the length of time it takes to arrive is no longer the artist’s responsibility.

Delivery of the Product

The product will be shipped via USPS tracked delivery or can be collected. The Client will be given the tracking number, and the product will be shipped in protective packaging.

Returns

Returns are not accepted unless the product has been damaged prior to the Client receiving it. The Client must make contact within 48 hours of receiving the product if this is the case. The cost of postage when returning any damaged products is the responsibility of the client.

Copyright

The artist retains the copyright of the work, so therefore has the right to use an image of the work for portfolios, this website, and social media. For privacy reasons, permission from the Client will be required before publishing of people portraits. The client does not have the right to sell copies of the work in any way without permission from the artist.

Data Protection

The artist will need to collect the following information: The Client’s name, address, and email address. This information will only be used to send invoices and to deliver the product. The client’s name will be stored to keep track of orders. Once the client has received the product, records of email addresses and addresses will be deleted. Any photos that have been saved or printed will also be destroyed.

Artwork Progress

Once artwork commences, photos of the progress will be sent to the Client, at this stage minor alterations can be made to its design content. Makenzie Wilson reserves the right to share “art in progress” photos on social media unless the Client expresses this not to be done, due to the painting being a surprise gift, for example. If the commission is stated as a gift, then no images of the piece will be published until the gift is received.
